Event Ticket - Terms & Conditions

Tickets for the 42BELOW Cocktail World Cup 2010 (the “Event”) are sold by 42 Below Limited (“42BELOW”) on the 42BELOW Cocktail World Cup 2010 website or from designated bars in Wellington. The Event will be held on Saturday 27th March 2010 at the Old Museum Building, Wellington (the “Venue”) from 7pm – 12pm.

Entry to the Venue and the Event is for guests who each hold a ticket, only (“Guests”).

The Event is fully licensed and is strictly R18. Guests must carry photo ID, which must be produced when purchasing a ticket, upon entry to the Venue and on request during the Event. Guests can only buy tickets if they are aged 18 or older at the time of purchase. Acceptable forms of photo ID are a current New Zealand driver’s license, a current passport and/or a proof of age card. If no acceptable photo ID is produced, ticket sale or entry will be refused, or Guests will be removed from the Venue and the Event.

Tickets cannot be exchanged, transferred or refunded after purchase, except in accordance with any applicable law. If a refund is required by law, liability is limited to a refund of the ticket price only. Any other fees and charges are non-refundable.

In the event of loss or theft of a ticket, the ticket will not be replaced.

42BELOW reserves the right to refuse admission to the Venue and the Event for any reasonable cause or where a ticket is lost, damaged, or where a ticket is not purchased through 42BELOW or an authorised point of sale.

Date, time and location of the Venue are subject to approval by the Department of Liquor Licensing and are dependent on any conditions to that approval and crowd behaviour throughout the Event. In the case of early closure, no monetary compensation will be offered.

42 BELOW may at its sole discretion withdraw, replace or substitute artists, or amend the programme, prices and/or other arrangements relating to the Event at any time.

42BELOW may at its sole discretion vary the format, date or timing of any element of the Event if it reasonably believes it is required to ensure that the Event is conducted in a professional and/or safe manner or for any other reasonable cause. Guests may not sell anything or offer anything for sale at the Venue.

Media

By purchasing the ticket and attending the Event Guests grant 42BELOW permission to capture and/or make records of images in any format whatsoever, whether as a photo, video, digital media or otherwise. All Guests agree that 42BELOW may, at its sole discretion, edit, modify or otherwise amend any record of the images and publish it in any form or media that it sees fit.

Any record of a Guest’s image taken by or on behalf of 42BELOW shall be owned by 42BELOW and Guests waive all rights to it including fees, payments, royalties or other benefits associated with it.

Beverages

The Venue will be a licensed premise and all alcoholic and non-alcoholic drinks must be purchased through 42BELOW or its contractors at the bars located at the Venue. No alcoholic or non-alcoholic drinks may be bought in or taken out of the Venue by Guests. Non compliance will result in drinks being confiscated and 42BELOW reserves all rights to initiate legal action against any relevant Guest.

Further conditions regarding drinks follow:

• The entry ticket allows for 4 free 42BELOW cocktails (Guests will receive four drinks tokens on entry);
• All other drinks will be served on a token system and a central cash-token exchange will be located at the Event; and
• All bars at the Event will, subject to Liquor Licensing approval and conditions, be opened from 7pm to 11.45pm.

It is an offence to sell or supply alcohol to any person who is already affected by liquor to the point of being intoxicated. Water, Redbull and juice will be available free of charge for all Guests.

Any person that in 42BELOW’s opinion behaves in an offensive manner including (but not limited to) being violent, quarrelsome, disorderly or indecent will be removed from the Venue and the Event.

All Guests must comply with all reasonable directions of 42BELOW staff and contractors at the Event, including (but not limited to) where directions relate to the health and safety of anyone attending or taking part in the Event.

Catering

Catering will be supplied by Nosh Catering and served via tray service throughout the Event free of charge.

No food may be brought in to the Venue by Guests.

Security

Security will be supplied by 42BELOW’s contractor (“Security”) and will be on site for the duration of the Event.

Upon entry to the Event, Guests consent to the reasonable inspection of their person and property by Security to ensure compliance with these terms and conditions and for any other reasonable purpose relating to security.

Guests must at all times comply with the directions of all 42BELOW staff and Security relating to security.

At any time during the Event, should a Guest behave in a manner that 42BELOW or Security considers is a reckless, irresponsible or dangerous manner, or is in a manner that unreasonably restricts or interferes with participants in the Event or the enjoyment of the Event by other Guests, or in a manner that 42BELOW considers in its absolute discretion to be unsatisfactory, 42BELOW or Security will remove the Guest from the Venue and the Event.

Guests assume all risk and danger incidental to events of the nature of the Event. Security at the Event will use its reasonable endeavors to deter reckless, irresponsible and dangerous behaviour and any other behavior that unreasonably restricts of interferes with participants in the Event or the enjoyment of the Event by other Guests, however 42BELOW will not accept any liability for any loss or damage to any Guests, or for any personal injury, ailment and/or death suffered by, or loss or damage to property suffered by, any Guest whilst at or around the Venue or during the Event.

Risk Management and Evacuation

In the unlikely event of an evacuation, Guests must follow the instructions of 42BELOW and its contractors and otherwise leave the Venue by the nearest available exit and assemble in the approved assembly area.

Information Booth

There will be many members of 42BELOW staff available at the Venue for the duration of the Event should Guests require assistance in any way.

First Aid

There will be two First Aid Posts at the Venue for the duration of the Event. Guests should seek medical assistance as soon as it is required.

42BELOW Commitment

42BELOW is committed to a safe, successful day for all Guests at the Event.

Personal Information

You authorise 42BELOW to collect and hold your personal information. It will not be sold or passed on to any other party. If you have opted to receive email updates from 42BELOW and have provided an email address, you will be sent email newsletters. You can opt out of receiving these newsletters at any time.

Status of these Terms and Conditions

In proceeding with the purchase of tickets for the Event you are agreeing to the above terms and conditions. If you purchase tickets on behalf of any other person or as an agent for any other person you must notify that person of the terms and conditions that apply to the Event.
